I represented a woman in her 50’s who was involved in a multi-vehicle accident on Route 73 in Marlton, NJ. She was traveling through a green light at an intersection on Route 73, when a car went through a red light, hit another vehicle, which then hit my client’s car head-on.
As a result of the accident, she sustained serious injuries. She fractured her foot and required multiple surgical procedures. The surgeries required placing hardware in her foot, specifically, multiple pins and a rod were placed in her foot. In addition, she also had a head injury.
My client worked as a publisher/proofreader, which required extensive concentration and focus. However, because of her head injury, she could not concentrate. She suffered from post-concussive symptoms that interfered with her work. She could not concentrate and would often get headaches after she tried to work.
In addition to not being able to work, her daily life was significantly affected. She could no longer perform daily chores, such as cleaning the house and standing for a long period of time to do other house chores such as cooking. In addition, because she needed multiple surgeries on her foot, she could not attend her son’s graduation.
These are significant injuries she sustained, and the type and amount of coverage she bought on her car insurance policy helped her obtain financial recovery for her losses.
I have always talked about the importance of underinsured motorist (UIM) coverage in a NJ driver’s car insurance policy. See: NJ Car and Truck Accident Lawyer Talks About When to File an Uninsured/Underinsured (UM/UIM) Motorist Claim in a Car or Truck Accident
UIM is a type of insurance coverage that protects the insured injured driver when the driver who caused the accident does not have enough liability coverage to compensate the injured driver’s damages and injuries. NJ drivers do not have to carry UIM coverage, and can in fact, turn down the coverage when purchasing a car insurance policy, but this is a mistake.
In my client’s situation, the other driver who caused the accident had $100,000 in liability coverage. My client’s injuries and damages well exceeded the driver’s liability coverage. Fortunately, she purchased a high UIM coverage and was able to recover her damages after we filed a UIM claim on her behalf.
If she did not have UIM coverage, she would only have been able to recover $100,000 and nothing more.
